Telehealth & Virtual Services Consent

This Telehealth & Virtual Services Consent ("Consent") governs your participation in all virtual coaching sessions, video calls, phone calls, and messaging-based support provided by Personomics. It should be read alongside our Membership & Coaching Agreement, HIPAA Notice of Privacy Practices, and Full Disclaimer.

Personomics virtual coaching sessions are not telehealth or telemedicine services as defined by applicable law. No medical diagnosis, prescription, or clinical treatment will be provided during any virtual session. See Section 2 for the full explanation.

1. About Virtual Coaching Sessions

Personomics delivers its health coaching programs primarily through virtual channels, including:

-Video calls via our secure scheduling and video platform

-Phone calls for coaching check-ins and support

-Asynchronous messaging through our secure member portal

-Group video sessions for community workshops, Q&As, and masterclasses

By enrolling in a Personomics Program and scheduling your first virtual session, you consent to receiving coaching services through these virtual channels under the terms described in this Consent.

2. Not Telehealth or Telemedicine

Personomics virtual coaching services are educational and wellness-focused in nature and are not telehealth, telemedicine, or clinical healthcare services as defined by applicable federal or state law. Specifically:

-Your Personomics coach is not acting as a licensed physician, psychologist, therapist, registered dietitian, or other licensed healthcare provider during virtual sessions

-Virtual coaching sessions do not constitute the practice of medicine, nursing, psychology, dietetics, or any other licensed health profession

-No clinical diagnosis, medical prescription, or treatment plan will be provided during any virtual session

-Virtual sessions do not create a physician-patient, therapist-patient, or any other licensed healthcare provider relationship

Information shared during virtual sessions does not constitute medical records as defined under applicable law, except where PHI is separately maintained in connection with your lab services (see our HIPAA Notice of Privacy Practices at personomics.io/hipaa-notice)

If you require medical advice, diagnosis, or treatment, please consult a licensed healthcare provider. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.

3. How Virtual Sessions Work

3.1 Platform & Technology

Personomics conducts virtual coaching sessions through secure, HIPAA-compliant video and messaging platforms. By participating in virtual sessions, you acknowledge that:

-You are responsible for having a stable internet connection and compatible device for video calls

-Technical issues on your end (e.g., poor connection, device failure) do not entitle you to a replacement session, though we will make reasonable efforts to reschedule in such cases

-You should participate in sessions from a private location to protect the confidentiality of your health discussions

3.2 Session Recording

Coaching sessions may not be recorded by either party without prior written consent from both the member and the Personomics coach. If you wish to record a session for personal reference, you must request permission in advance. Unauthorized recording of sessions is a violation of this Agreement and may result in termination of your membership.

3.3 Children on Calls

Members under 18 years of age must have a parent or legal guardian present on all video calls. The parent or legal guardian must be visible and actively present — not simply in the same room. By allowing a minor to participate in a virtual session, the parent or guardian consents to the session on the minor's behalf and accepts responsibility for the minor's participation.

The coach will terminate the virtual session if the parent or legal guardian is not visible at all times.

4. Privacy & Confidentiality of Virtual Sessions

4.1 Our Commitment

Personomics is committed to protecting the confidentiality of information shared during your virtual coaching sessions. Your coach will not share the content of your sessions with third parties except as described in our Privacy Policy and HIPAA Notice of Privacy Practices, or as required by law.

4.2 Limits of Confidentiality

There are limited circumstances under which information from your sessions may be disclosed without your consent, including:

-Where disclosure is required by applicable law or court order

-Where there is a serious and imminent threat to your health or safety or the health or safety of another person

-Where disclosure is necessary to prevent fraud or abuse

-Where your PHI is shared with our lab partner EquiLife or licensed clinicians as necessary to deliver your Program, as described in our HIPAA Notice of Privacy Practices

4.3 Communication Security

While we use secure, encrypted platforms for virtual sessions and messaging, no method of electronic communication is 100% secure.

By participating in virtual sessions and using our messaging platform, you acknowledge this inherent limitation. We recommend that you do not share highly sensitive information (such as full Social Security numbers, financial account details, or sensitive medical information unrelated to your coaching program) through our platform.

5. Risks & Benefits of Virtual Coaching

5.1 Potential Benefits

-Convenient access to personalized health coaching from your home or any location

-Flexible scheduling without the need to travel

-Access to Dr. Cabral's methodology and the Personomics coaching team regardless of your geographic location

-Timely review and discussion of your lab results and P360 Plan

5.2 Potential Limitations

-Your coach cannot physically examine you, which limits the scope of wellness guidance that can be provided compared to in-person clinical care

-Technical difficulties may occasionally interrupt or delay sessions

-Virtual coaching is not a substitute for in-person medical care when physical examination or clinical intervention is required

-The quality of your coaching experience may be affected by the quality of your internet connection and device

6. Your Responsibilities

By participating in virtual coaching sessions, you agree to:

-Provide accurate and complete health information to your coach to the best of your ability

-Participate from a private, distraction-free location when possible

-Notify your coach in advance if you need to reschedule, with at least 24 hours' notice

-Not record sessions without prior written consent from your coach and Personomics

-Not share your session login links or access credentials with any third party

-Consult a licensed healthcare provider for any medical concerns that arise during or after your coaching sessions

-Inform your coach of any significant changes to your health status, medications, or treatment plan

7. Emergency Protocol

Virtual coaching sessions are not an appropriate channel for health emergencies. If at any point during a virtual session you experience or report a medical emergency, your coach will:

-Direct you to call 911 or your local emergency number immediately

-End or pause the session as appropriate

-Personomics coaches are not trained emergency responders and cannot provide emergency medical assistance through virtual platforms. If you are in crisis or experiencing a medical emergency, stop the session and call 911 immediately.

8. State-Specific Notices

Virtual coaching services are available across the United States and in select international locations (Australia, Canada, New Zealand, and the United Kingdom for lab-inclusive programs). Because Personomics operates nationally, the following applies:

-Personomics coaches operate under the scope of wellness coaching and integrative health education, which is distinct from licensed healthcare practice in all U.S. states

-Personomics does not represent that its virtual services constitute telehealth under any state's telehealth laws, and members should not interpret virtual coaching as a substitute for state-regulated telehealth or medical services

-Some states may have specific requirements regarding virtual health services. If you have questions about the availability of services in your state, contact [email protected]

9. Acknowledgment of Consent

By scheduling and attending your first virtual coaching session with Personomics, you confirm that:

-You have read and understood this Telehealth & Virtual Services Consent

-You understand that virtual coaching sessions are educational and wellness-focused and do not constitute telehealth, telemedicine, or medical care

-You consent to receiving coaching services through virtual channels as described in this Consent

-You understand the potential benefits and limitations of virtual coaching

-You agree to your responsibilities as outlined in Section 6

By checking the box at enrollment and/or scheduling your first session, you provide your informed consent to all terms described in this Telehealth & Virtual Services Consent. This consent will be recorded with your account.
